1. Introduction
Welcome to CornerstoneCommons ("we," "us," or "our"). These Terms & Conditions ("Terms") manage your engagement with our yacht charter offerings and our online platform at cornerstonecommons.sbs (the "Service"), which is run by CornerstoneCommons.
In booking a charter or using our Service, you consent to these Terms. Should you not agree with any part of these terms, you are not permitted to use the Service.
2. Service Overview
CornerstoneCommons offers upscale yacht chartering services, which include, but are not limited to:
- Yacht hires for the day
- Evening yacht trips
- Corporate getaways
- Exclusive functions
- Prolonged yacht charters
All offerings are contingent on availability and meteorological conditions. We hold the right to adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you must:
- Be of minimum 18 years old
- Submit accurate and complete details
- Remit the necessary deposit as outlined in your booking acknowledgement
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is only confirmed after the payment is made and acknowledged by us in writing. We have the discretion to reject service to any individual.
3.3 Availability
Charter bookings are dependent on vessel availability and appropriate weather conditions. We endeavor to satisfy your preferred dates and timings to the best of our ability.
4. Payment Terms
4.1 Pricing
All quoted amounts are in € and comprehend all applicable taxes, unless indicated otherwise. Prices are variable and can change without prior notice.
4.2 Payment Schedule
- Initial deposit: 50% of the full charter cost is payable at the time of reservation
- Remaining balance: Payable 48 hours before departure
- Incidental charges (if applicable): Payable after the completion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, bank transfers, and certified cheques. Our secure, encrypted systems handle all payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: Full reimbursement minus transaction fees
- Within 24-72 hours of departure: 50% reimbursement
- Within less than 24 hours of departure: No reimbursement
5.2 Weather Cancellations
In case our captain assesses weather conditions as unsafe, the options we provide will be:
- To rebook your charter for a subsequent available date without extra charges
- To issue a complete refund if rescheduling cannot be accommodated
5.3 Mechanical Issues
If a mechanical issue arises with the designated vessel, we will endeavor to offer a comparable alternative. If no equivalent vessel is accessible, you will be granted a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Comply with all directions given by the crew
- Utilize the safety equipment provided when instructed
- Report any medical conditions that may impact their safety
- Stay within the allocated areas of the yacht
6.2 Prohibited Items
The following are not allowed on the yacht:
- Glassware
- Illegal substances
- Firearms or other armaments
- Excessively large quantities of soft drinks or lemonade (beyond regular consumption)
- Animals (unless granted prior consent)
6.3 Conduct
Passengers are expected to behave in a considerate and respectful manner. We retain the right to terminate a charter prematurely without refund if the conduct of any passenger represents a safety hazard or spoils the excursion for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is constrained to the amount paid for the yacht charter. We are not liable for:
- Personal harm owing to your negligence
- The loss or damage of personal items
- Indirect or substantial damages, or punitive repercussions
- Delays stemming from weather or other circumstances beyond our control
7.2 Insurance Coverage
We possess comprehensive maritime insurance for our vessels and operations. Passengers should arrange their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our yachting services signifies acknowledgement of the inherent risks in maritime activity, accepting responsibility for your safety and health.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, paths, or timetables due to weather considerations, safety requirements, or operational needs. All efforts will be made to ensure a comparable alternative experience is provided.
9. Force Majeure
We hold no liability for delays, cancellations, or changes caused by events beyond our control, which can include but are not limited to:
- Extreme weather conditions
- Natural catastrophes
- Governing laws
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal information per our Privacy Policy. By using our service, you allow the collection and use of your information as detailed in our Privacy Policy.
11. Intellectual Property
All material on our website, including text, visuals, trademarks, and imagery, is under copyright and intellectual property laws. Reproducing, distributing, or creating derivative works without our express consent is prohibited.
12. Governing Law
These Terms are under the jurisdiction of the laws in Spain. Disagreements will be resolved in courts located in Palma de Mallorca, Spain.
13. Changes to Terms
We reserve the prerogative to amend these Terms when necessary. Alterations will be published on our website with the revision date updated. Continuing to use our services indicates acceptance of the revised terms.
